Operating a motor vehicle while impaired by intoxicating substances, whether alcohol or drugs, or refusing any breathalyzer testing or drug testing, constitute a Criminal Code of Canada offence.

The laws surrounding these offences have undergone substantial transformations in the past few years. Recent amendments to the Criminal Code have provided prosecutors with a more straight forward path to secure convictions. The complexity involved with respect to these offences make it imperative to engage the services of lawyers experienced in this area of law.

Once we have been hired, the lawyers at Genesee Law will require the Crown to provide full disclosure of the Crown's case. This disclosure encompasses various materials, such as the officer's notes, video footage of any breath testing, breathalyzer data, witness statements, including police officer's notes and evidence. We scrutinize the disclosure materials to develop any appropriate legal defences. In addition, we conduct thorough interviews of our client, and any defence witnesses, in order to advance a robust defence, including resolution meetings with the appropriate Crown Prosecutor, and including any appropriate judicial pretrial in order to attempt to resolve the case without the need for a trial, or to proceed to trial, if necessary.   •   Negative impact on person's employment, or future job prospects.
  •   Monetary fines of a minimum of $1,000.00, and a maximum of$50,000.00 if the driver causes bodily harm or death.
  •   Driver's licence suspensions for lengthy period.
  •   Requirement to drive only a vehicle with an interlock ignition control system in it for a period of nine months to several years.
  •   Requirement to complete a driver/alcohol education course.
  •   Insurance premium increases sometimes reaching exorbitant levels.
